    Unfair Dismissal — Key Figures

The thresholds, caps and deadlines that decide an unfair dismissal claim — for both sides of the conversation.

    Key figures (2025-26)

High income threshold $183,100 (from 1 July 2025)
Compensation cap $91,550 (lesser of 26 weeks' pay or half the high income threshold)
Lodgement window 21 days from the dismissal taking effect

Minimum employment period (before a claim can be made)

Employer with 15+ employees 6 months
Small business (under 15 employees) 12 months

    Small business

    • Employers with under 15 employees are covered by the Small Business Fair Dismissal Code — follow it and a dismissal is deemed fair
Guidance only — not legal advice. The 21-day window is strict and rarely extended. Figures current 2025-26. Check fwc.gov.au.
