When's your payment claim due — and when can you act?
For subbies and small firms using Security of Payment. Pick your state and the date you served your payment claim to see the respondent's reply deadline, when payment falls due, and your next move.
Sound familiar?
- “You served a claim and you're not sure when they have to respond by.”
- “You've heard the adjudication window is tight but no one's told you how tight.”
- “The deadlines are different in every state and you work across a couple.”
What this tool does
Applies your state's Security of Payment Act to the date you served your payment claim — the respondent's deadline to serve a payment schedule, the default due date for payment, and what you can do if they miss it. These deadlines run on business days and differ by state.
What the law actually says
- •Every state and territory has its own Security of Payment Act. Serve a valid payment claim and the respondent has a set number of business days to reply with a payment schedule — miss it and they generally become liable for the full amount.
- •Business days exclude weekends and public holidays, and your contract can set SHORTER deadlines than the statutory maximum. Adjudication windows are short and strict.
- •Guidance only, not legal advice — confirm against your state's Act and get advice before adjudicating.
